Sweepstakes Name

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are 21 years of age. Employees, officers, directors and agents of Colwen Management, Inc. (“Sponsor”) and each of their respective employees, representatives, franchisees, parents, retailers, distributors, subsidiaries, affiliates, suppliers, and advertising agencies (collectively, the “Sweepstakes Entities”), along with members of the immediate family or same household as any employee thereof, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Eligibility and all facts may be verified at any time, and all Sweepstakes entrants (“Entrants”) agree to cooperate in any verification process/request.  

2. SWEEPSTAKES PERIOD: The Sweepstakes begins on X/X/XX, at X:XX:XX AM Eastern Time (“ET”) and ends on X/XX/XX, at XX:XX:XX PM ET (the “Sweepstakes Period”). The Sponsor’s database clock is the official timekeeper for this Sweepstakes.  

3. HOW TO ENTER: During the Sweepstakes Period, locate the Instagram post about the Sweepstakes on the Sponsor’s official Instagram account [Link] (“Sweepstakes Posts”). Then, do all of the following to earn one (1) entry into the Sweepstakes:  

   (a) Follow @diamondsedgerestaurant

   (b) Like the Post promoting the Sweepstakes 

   (c) Share the Post by using Instagram’s native ‘Share’ feature (e.g., sending via direct message or reposting to your Instagram Story). No tagging of individuals in the comments is required or encouraged. 

IMPORTANT: You must have an Instagram account set to “public” and your account must have direct messaging (or private message) enabled. The account must remain “public” through winner selection. Creating an Instagram account is free and can be achieved by visiting http://www.instagram.com and following the onscreen instructions. Your Instagram account activities, including any with respect to this Sweepstakes, are subject to any applicable terms and privacy policies of Instagram. 

Limit of one (1) entry per person and per Instagram account. Any attempt to enter more than one (1) time during the Sweepstakes Period by any means, including, but not limited to, use of multiple identities, email addresses, Instagram accounts, or other means, may result in disqualification from this and any other promotional offerings by Sponsor. Use of any macro, bot, script or other automated means to submit entries is prohibited.   In the event of a dispute over the identity of the Entrant in connection with an electronic entry, the entry will be deemed submitted by the authorized account holder of the e-mail address associated with the Account associated with the entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 

4. WINNER SELECTION AND NOTIFICATION: [Number](#)grand prize winner and [Number](#) first prize winners will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period, on or about XX/XX/XXXX.

Entrants irrevocably agree to be bound by these Official Rules and by the decisions of the judges, which are final and binding in all respects. Potential winners will be notified via direct message to the Instagram account used to enter. If the winner notification is returned as non-deliverable, the potential winner may be disqualified, and an alternate winner may be selected. No liability is assumed for any winner notification that is lost, intercepted, returned as undeliverable, or not received by a potential winner for any reason. Failure to respond to any winner notification within five (5) days will result in disqualification and selection of an alternate winner. Failure to comply when requested will result in disqualification and selection of an alternate winner. In the event that a potential winner is found ineligible, or if they have not complied with these Official Rules or decline a prize for any reason prior to award, such potential winner will be disqualified, and an alternate winner may be selected. Each winner may be required to sign and return an Affidavit of Eligibility, a Liability Release, and where legally permissible, a Publicity Release (collectively, "Prize Claim Documents"). If a potential winner fails to comply with requests for the Prize Claim Documents, he/she may be disqualified, and the prize may be awarded to an alternate winner.

Winners are solely responsible for the payment of all federal, state and local taxes, and for any other fees or costs imposed as a result of acceptance or use of any prize. Prizes are non-transferable and no cash equivalents or substitutions of the prizes are offered, except at the sole discretion of the Sponsor.  Sponsor reserves the right to substitute any prize for one of equal or greater value if the advertised prize becomes unavailable. Prizes do not include alcoholic beverages or gratuities.   

Limit one (1) prize per person and per household.  

6. ODDS: Odds of winning depend on the number of eligible entries received. 

7. MISCELLANEOUS: The Sweepstakes Entities are not responsible for any (a) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (b) telephone, computer, mobile device, hardware, software, programming or network malfunction or other technical failures or errors, or the failure to properly process entries; (c) communication disruption or other forces beyond the reasonable control of the Sponsor, including but not limited to disruption related to internet traffic, wireless networks, virus, bug or non-authorized intervention; or (d) damage caused by a computer or mobile device related virus or otherwise resulting to any computer or mobile device from such person’s participation in the Sweepstakes whether human, mechanical or electronic. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the end date, Sponsor will post a notice on [Link] and, to the extent possible, winner(s) will be selected from among all eligible entries unaffected by any error that were received as of the termination date. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption, or damage will be disqualified. Entries that contain errors or are incomplete or received after the relevant entry period, will not be accepted. Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of such winner’s name, likeness, photograph, voice, opinions and/or hometown and state or province for promotional purposes in any media now, or hereafter, known throughout the world in perpetuity, without further compensation or other consideration, permission, or notification. 

8. RELEASE OF LIABILITY: By participating, each Entrant releases the Sweepstakes Entities and all others associated with the development and execution of the Sweepstakes (the “Released Parties”) from and against any and all injury, loss or damage caused or claimed to be caused by their participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and each Entrant agrees that the Released Parties are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding of any prize except as expressly provided in these Official Rules. By participating, each Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; (c) under no circumstances will any Entrant be permitted to obtain any award for, and each Entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Official Rules and all disputes shall be governed by the internal laws of the state of GOVERNING STATE, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of GOVERNING STATE, and each Entrant expressly consents to the jurisdiction of said courts and waives any objection thereto. For New Jersey residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.

WARNING: ANY ATTEMPT BY AN ENTRANT, OR ANY OTHER PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES AND OTHER ASSOCIATED LEGAL COSTS) FROM ANY SUCH ENTRANT, OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO SEEKING CRIMINAL PROSECUTION. 

9. DATA:  Any information Entrant submits is subject to Sponsor’s privacy policy located at https://colwenhotels.com/privacy-policy/. Entrants acknowledge and agree that by participating in the Sweepstakes and providing any personal information, subject to applicable law, Sponsor and Administrator may collect and use such personal information provided for the purposes of conducting the Sweepstakes and as otherwise permitted in Sponsor’s referenced privacy policy.  

10. WINNER LIST: For the list of winners’ names (available after DATE), send a hand-printed, self-addressed, stamped envelope to: Sweepstakes Name, Address. Requests must be received no later than DATE.
